These Terms of Service (“Terms”) govern your access to and use of the RiseMove™ mobile application, website, Today Signal, Daily Move Score, activity tracking, weekly planning, Hank™ coaching features, connected health and activity integrations, and related services collectively referred to as the “Service.”
Please read these Terms carefully.
1. Acceptance of Terms
By downloading, installing, creating an account, accessing, purchasing, or using RiseMove™, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use RiseMove™.
You confirm that:
- You are at least 13 years old or the minimum age required in your jurisdiction.
- You have the legal capacity to agree to these Terms.
- The information you provide is accurate to the best of your knowledge.
- You will use RiseMove™ only for lawful purposes.
If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms as required by applicable law.
2. Description of the Service
RiseMove™ is The Movement Decision Engine™: a movement-guidance application that provides general fitness guidance, activity tracking, readiness-based signals, planning, adaptation, and coaching features.
RiseMove™ may provide:
- A Today Signal or Daily Move Score
- Suggested movement categories such as Move, Build, Train, Recover, or Restore
- General movement recommendations
- Activity recording and history
- Apple Health, HealthKit, Motion and Fitness, Strava, Health Connect, or other integrations
- Daily check-ins
- Weekly movement planning
- Hank™ AI-generated coaching-style explanations
- Premium planning, adaptation, insights, and coaching features
- Optional user content and sharing features
RiseMove™ may use information you provide, connected activity data, completed workouts, check-ins, preferences, goals, and other available context to generate guidance.
Features may be added, modified, suspended, or discontinued over time.
3. No Medical Advice or Medical Device
RiseMove™ is not a medical device, healthcare provider, emergency service, physical therapist, personal trainer, rehabilitation service, or substitute for professional medical judgment.
RiseMove™ does not provide:
- Medical advice
- Diagnosis
- Treatment
- Injury prevention guarantees
- Emergency monitoring
- Rehabilitation instructions
- Medical clearance to exercise
- Assurance that any activity is safe or appropriate for you
Today Signals, Daily Move Scores, confidence indicators, movement suggestions, weekly plans, Hank™ responses, and related content are general informational fitness and movement guidance only.
Do not use RiseMove™ to diagnose, treat, monitor, or manage a disease, medical condition, injury, or emergency.
Consult a qualified healthcare professional before beginning or changing an exercise program, particularly if you have a medical condition, injury, disability, pregnancy, recent surgery, unexplained symptoms, or concerns about your ability to exercise safely.
4. Stop-Activity and Emergency Warning
Stop activity immediately if you experience pain, chest discomfort, unusual shortness of breath, dizziness, fainting, confusion, weakness, loss of coordination, severe fatigue, or other concerning symptoms.
Seek appropriate medical assistance when necessary.
Do not submit an emergency or urgent health concern to Hank™ or rely on RiseMove™ to contact emergency services.
RiseMove™:
- Does not continuously monitor your health or location
- Does not detect emergencies
- Does not supervise your activity
- Does not summon assistance
- Does not notify another person if you become injured, lost, incapacitated, or unresponsive
In an emergency, contact local emergency services immediately.
5. Your Responsibility for Safety
You are solely responsible for deciding whether, when, where, and how to participate in any activity.
Before beginning an activity, you are responsible for evaluating:
- Your health, fitness, experience, and physical limitations
- Pain, soreness, fatigue, illness, injury, hydration, and other symptoms
- Weather, heat, cold, air quality, visibility, and environmental conditions
- Traffic, intersections, road surfaces, trails, terrain, lighting, and surroundings
- Water depth, currents, pool conditions, supervision, and swimming ability
- Equipment condition, footwear, protective equipment, and proper technique
- Local laws, traffic rules, facility rules, warnings, and restrictions
- Whether professional instruction, supervision, assistance, or medical clearance is appropriate
A RiseMove™ recommendation does not mean that an activity, route, environment, facility, body of water, roadway, trail, piece of equipment, duration, intensity, or movement is safe.
RiseMove™ does not inspect or verify real-world conditions.
You must use independent judgment, remain aware of your surroundings, obey applicable laws, and choose activities appropriate for your circumstances.
Do not interact with the app while driving, cycling, running in traffic, operating equipment, swimming, or performing any activity where distraction could create a risk.
6. Assumption of Risk
PHYSICAL ACTIVITY INVOLVES INHERENT AND OTHER RISKS, INCLUDING SERIOUS INJURY, ILLNESS, PERMANENT DISABILITY, PROPERTY DAMAGE, AND DEATH.
Risks may include, without limitation:
- Falls, collisions, and traffic accidents
- Drowning or water-related injury
- Heat illness, dehydration, or exposure
- Strains, sprains, tendon injuries, fractures, and overuse injuries
- Cardiac, respiratory, neurological, or other medical events
- Equipment failure
- Unsafe roads, trails, facilities, weather, terrain, or surroundings
- Errors, omissions, delays, incomplete data, inaccurate sensor readings, or incorrect recommendations
- Actions or negligence of other people
By voluntarily using RiseMove™ and participating in physical activity, you knowingly acknowledge and assume all inherent and reasonably foreseeable risks associated with your activity choices, except to the extent a risk cannot legally be assumed or waived.
7. Release of Claims
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU RELEASE AND AGREE NOT TO HOLD LIABLE RISEMOVE™, PAUL RUSSELL, AND THEIR AFFILIATES, CONTRACTORS, SERVICE PROVIDERS, REPRESENTATIVES, SUCCESSORS, AND ASSIGNS FOR CLAIMS, LOSSES, DAMAGES, OR INJURIES ARISING FROM OR RELATED TO:
- Your decision to begin, continue, modify, or stop an activity
- Your reliance on a Today Signal, Daily Move Score, recommendation, weekly plan, Hank™ response, notification, or other content
- Your failure to evaluate your health, surroundings, equipment, route, traffic, water, weather, or other conditions
- Activity tracking errors, missed notifications, location errors, incomplete data, delayed imports, or device failures
- Ordinary negligence relating to the design or provision of general movement guidance, to the extent such a release is enforceable under applicable law
This release does not apply to gross negligence, willful or intentional misconduct, fraud, or any liability that cannot legally be excluded or waived.
8. Daily Move Score, Signals, Confidence, and Recommendations
RiseMove™ may display a Daily Move Score, Today Signal, confidence indicator, recommendation, or similar output.
These outputs:
- Are estimates based on available information
- May be incomplete or incorrect
- May be affected by missing, delayed, inaccurate, or conflicting data
- Are not medical assessments or guarantees
- Do not establish that an activity is safe
- Should not override symptoms, professional advice, common sense, or real-world conditions
When RiseMove™ has limited information, it may display a Learning state or initial guidance rather than a personalized numerical score.
You remain responsible for deciding whether a recommendation is appropriate.
9. Hank™ and Artificial Intelligence
Hank™ uses artificial intelligence to provide coaching-style explanations, suggestions, and planning assistance.
After you agree to AI processing, your messages and limited relevant app context may be sent to OpenAI to generate a response. That context may include your profile, goals, check-ins, Today Signal, readiness, sleep duration, training load, movement plan, and recent activity summaries. Hank™ does not receive a complete copy of your Apple Health or Health Connect records.
AI-generated content may:
- Contain errors
- Misinterpret information
- Omit important considerations
- Be repetitive, outdated, incomplete, or inappropriate
- Fail to account for your health, environment, equipment, or circumstances
Do not rely on Hank™ for medical decisions, emergency instructions, injury treatment, diagnosis, medication guidance, or professional healthcare advice.
Hank™ does not replace a physician, physical therapist, certified trainer, coach, attorney, or other qualified professional.
You should independently evaluate Hank™ responses before acting on them.
10. Connected Health and Activity Integrations
RiseMove™ may allow you to connect Apple Health and HealthKit, Google Health Connect, Strava, device motion and fitness services, or other third-party services.
Connecting an integration is optional unless clearly required for a specific feature.
Imported information may be incomplete, delayed, duplicated, unavailable, or inaccurate because of:
- Device settings
- Permission choices
- Third-party service limitations
- Connectivity
- Sync delays
- Sensor limitations
- Source-app errors
- Software changes
- User configuration
RiseMove™ does not guarantee that every workout or data point will be imported, detected, displayed, reconciled, or used correctly.
You are responsible for reviewing imported activities and reporting significant errors.
Your use of third-party services is also governed by their applicable terms and privacy practices.
RiseMove™ is not endorsed by Apple, Strava, Garmin, Google, or another third party unless expressly stated.
11. Your Data and User Content
As between you and RiseMove™, you retain ownership of the original information and content you provide, including profile information, check-ins, notes, photos, and other user-created content.
You grant RiseMove™ a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, display, analyze, and process your information and content only as reasonably necessary to:
- Operate the Service
- Provide requested features
- Generate recommendations and plans
- Maintain your account and history
- Provide support
- Protect security and prevent abuse
- Improve the Service using permitted data
- Comply with legal obligations
This license ends when the applicable information is deleted, subject to reasonable backup, legal, security, fraud-prevention, and operational retention described in the Privacy Policy.
You are responsible for content you create, upload, or share.
Before sharing an activity, route, map, photo, or location-related content, you are responsible for reviewing its visibility and determining whether it could reveal a home, workplace, school, recurring location, private destination, or another person’s information. Privacy controls or route-obscuring features may reduce exposure but cannot guarantee that a location or identity cannot be inferred.
You must not submit content that is illegal, infringing, fraudulent, threatening, abusive, hateful, sexually exploitative, defamatory, invasive of privacy, malicious, or unsafe.
12. Privacy and Sensitive Data
Your use of RiseMove™ is governed by our Privacy Policy.
RiseMove™ does not sell personal data or connected health data to advertisers, data brokers, or information resellers.
Apple Health, Health Connect, and similar fitness data will be used only for permitted health, fitness, activity, planning, coaching, account, security, and app-functionality purposes described in the Privacy Policy and user-facing permission screens.
RiseMove™ may use service providers to operate hosting, AI, analytics, diagnostics, subscription management, support, and other functions. Information shared with service providers is limited to what is reasonably necessary for their assigned services and is subject to applicable contractual and technical safeguards.
No electronic system can be guaranteed completely secure.
You may revoke device permissions, disconnect supported integrations, request a copy of eligible information, or request account deletion as described in the Privacy Policy.
13. Account Security and Deletion
You are responsible for:
- Protecting your login credentials
- Maintaining accurate account information
- Preventing unauthorized use of your account
- Notifying RiseMove™ of suspected unauthorized access
RiseMove™ provides an in-app account deletion process where required. You may also follow the instructions at risemoveapp.com/delete-account or contact paul@risemoveapp.com.
Account deletion generally removes or de-identifies active account information controlled by RiseMove™, subject to information retained temporarily or as required for:
- Backups
- Security
- Fraud prevention
- Transaction records
- Legal obligations
- Dispute resolution
- Enforcement of these Terms
- Records controlled independently through Apple Health, Health Connect, the App Store, Google Play, Strava, OpenAI, or another third party
Revoking Apple Health or Health Connect access prevents future access but does not automatically delete workout or activity summaries previously imported and stored by RiseMove™. You must use the account or data deletion process to request deletion of stored RiseMove™ copies.
14. Premium Subscriptions and Purchases
RiseMove™ may offer an auto-renewable subscription called RiseMove Premium.
Premium features may include:
- Personalized weekly planning
- Adaptive plan changes
- Plan editing and rescheduling
- Plan-aware Hank™ coaching
- Weekly reviews and progress insights
- Expanded coaching conversations
- Other paid features described in the app, App Store, or Google Play
Purchases made through the iOS app are processed by Apple through the App Store. Purchases made through the Android app are processed by Google through Google Play.
The price, billing period, trial or introductory offer, renewal terms, and product description shown in the applicable store purchase screen at the time of purchase control.
Subscriptions automatically renew unless canceled in accordance with the applicable App Store or Google Play rules.
You can manage or cancel a subscription through the Apple or Google account used to make the purchase and its subscription settings.
RiseMove™ uses RevenueCat to support purchase verification, entitlement access, restore purchases, subscription status, and related operations.
RiseMove™ does not receive or store your complete payment-card information or your Apple ID or Google account password.
Refund requests and store billing disputes are generally handled by Apple or Google under the applicable store policies. The applicable store terms also govern your purchase.
Premium features may change over time, subject to applicable law and platform requirements.
15. Service Availability and Changes
RiseMove™ does not guarantee that the Service will always be available, uninterrupted, error-free, secure, or compatible with every device or third-party service.
Features may be limited or unavailable because of:
- Maintenance
- Software defects
- Device limitations
- Internet or GPS availability
- Apple, Google, Strava, RevenueCat, AI-provider, mapping, hosting, or other third-party changes
- Regulatory or platform requirements
- Events outside our reasonable control
We may modify, suspend, restrict, or discontinue features when reasonably necessary.
16. Prohibited Uses
You may not:
- Use RiseMove™ for an unlawful or fraudulent purpose
- Attempt to gain unauthorized access to the Service or another user’s information
- Interfere with security or normal operation
- Reverse engineer or exploit the Service except where legally permitted
- Upload malware or harmful code
- Misrepresent your identity
- Use automated systems to scrape or overload the Service
- Use RiseMove™ to supervise or direct another person’s medical care
- Represent RiseMove™ guidance as professional medical advice
- Use the Service in a manner that creates an unreasonable safety risk
17. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RISEMOVE™ IS PROVIDED “AS IS” AND “AS AVAILABLE.”
RiseMove™ disclaims all express and implied warranties, including warranties of:
- Merchantability
- Fitness for a particular purpose
- Accuracy
- Reliability
- Availability
- Non-infringement
- Safety
- Compatibility
- Results
RiseMove™ does not warrant that:
- Recommendations will be correct or appropriate
- Use of the Service will improve health, fitness, performance, or consistency
- Activity data will be complete or accurate
- Injuries, accidents, illness, or overtraining will be prevented
- Every workout will sync or be recorded
- Hank™ responses will be accurate or complete
- The Service will meet every user’s needs
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RISEMOVE™, PAUL RUSSELL, AND THEIR AFFILIATES, CONTRACTORS, SERVICE PROVIDERS, REPRESENTATIVES, SUCCESSORS, AND ASSIGNS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF USE, ARISING FROM OR RELATED TO THE SERVICE.
To the maximum extent permitted by law, the total aggregate liability arising from or related to RiseMove™ will not exceed the greater of:
- The amount you paid directly for RiseMove Premium during the 12 months preceding the event giving rise to the claim; or
- One hundred U.S. dollars
These limitations apply regardless of the legal theory asserted and even if RiseMove™ was advised that damages were possible.
These limitations do not apply to gross negligence, willful misconduct, fraud, or liability that cannot legally be limited.
Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.
19. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless RiseMove™, Paul Russell, and their affiliates, contractors, representatives, successors, and assigns from claims, liabilities, damages, losses, and reasonable costs arising from:
- Your unlawful or prohibited use of the Service
- Your violation of these Terms
- Content you upload or share
- Your violation of another person’s rights
- Your intentional misconduct or misuse of the Service
This section does not require you to indemnify RiseMove™ for claims caused solely by RiseMove™’s gross negligence or intentional misconduct.
20. Intellectual Property, Trademarks, and Brand Assets
RiseMove™, The Movement Decision Engine™, Hank™, the RiseMove neon runner icon, the RiseMove wordmark, related logos, slogans, color treatments, interface designs, visual presentation, trade dress, software, text, graphics, and other original Service content are proprietary to Paul Russell or are licensed for use in the Service, except for user-owned content and identified third-party materials.
The ™ symbol identifies marks claimed by their owner and does not represent that federal registration has already issued. All goodwill arising from permitted use of the RiseMove marks and brand assets benefits their owner.
These Terms do not transfer ownership of any RiseMove intellectual property to you. Except as expressly permitted in writing or required by applicable law, you may not copy, modify, reproduce, publish, distribute, sell, license, frame, mirror, remove proprietary notices from, or create derivative works from RiseMove intellectual property.
You may not use or adopt any name, logo, icon, app-store identity, domain name, social-media identifier, slogan, design, or trade dress that is identical or confusingly similar to RiseMove™, The Movement Decision Engine™, Hank™, or the neon runner icon, or that falsely suggests sponsorship, affiliation, endorsement, or ownership.
You receive only a limited, personal, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose. Third-party names and marks remain the property of their respective owners.
21. Termination
You may stop using RiseMove™ at any time.
We may restrict, suspend, or terminate access if we reasonably believe that you:
- Violated these Terms
- Created a safety, legal, security, or fraud risk
- Misused the Service
- Infringed another person’s rights
- Failed to pay for an applicable paid service
Sections that by their nature should survive termination will remain effective, including risk assumption, disclaimers, limitations of liability, intellectual property, indemnification, and dispute provisions.
22. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, any dispute arising from or related to these Terms or RiseMove™ will be brought in a state or federal court with appropriate jurisdiction located in Orange County, Florida.
You and RiseMove™ consent to personal jurisdiction and venue in those courts.
23. Changes to These Terms
We may update these Terms to reflect changes to the Service, law, security practices, integrations, subscriptions, or business operations.
When material changes are made, we may provide notice through the app, by email, or on the website.
The updated effective date will appear at the top of these Terms.
Where required by law, we will request renewed acceptance.
24. Severability and Entire Agreement
If a provision of these Terms is found unenforceable, it will be enforced to the maximum extent legally permitted, and the remaining provisions will remain effective.
These Terms, the Privacy Policy, and any applicable purchase terms form the entire agreement between you and RiseMove™ regarding the Service.
Failure to enforce a provision does not waive the right to enforce it later.
