Terms of Service | RiseMove™

1. Acceptance of Terms

Please read these Terms of Service (“Terms”) carefully before using RiseMove™. By downloading, installing, creating an account, accessing, or using RiseMove™, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use RiseMove™.

You confirm that you are at least 13 years old or the minimum age required in your jurisdiction to use the app.

2. Description of Service

RiseMove™ is a fitness, movement tracking, and daily movement guidance application. It is designed to help users understand what type of movement may fit their day through the Today Signal experience, movement recommendations, tracking, reflection, weekly planning, and Hank™ coaching-style guidance.

RiseMove™ may support walking, cycling, running, gym activity, swimming, recovery activities, Apple Health or Motion and Fitness data, Strava or other third-party integrations, optional sharing, and account-based features. Features may change as the app is developed, improved, and expanded after launch.

3. Fitness and Health Disclaimer

RiseMove™ is not a medical device and does not provide medical advice, diagnosis, treatment, emergency assistance, injury prevention guarantees, or professional healthcare guidance.

Hank™ and RiseMove™ recommendations are general fitness and movement guidance only. Always consult a qualified healthcare professional before beginning or changing an exercise program, especially if you have a medical condition, injury, pregnancy, pain, dizziness, chest pain, shortness of breath, fainting, or other health concern.

Stop exercising immediately if you experience pain, dizziness, chest discomfort, unusual shortness of breath, fainting, or other concerning symptoms and seek medical attention as appropriate. You are responsible for exercising safely, using reasonable judgment, following local laws and traffic rules, and choosing activities appropriate for your condition and environment.

By using RiseMove™, you acknowledge that physical activity involves inherent risks and that you voluntarily assume those risks.

4. Hank™ AI Guidance

Hank™ provides coaching-style explanations and movement suggestions based on available context. Hank™ responses may be incomplete, inaccurate, or inappropriate for your specific health situation. You should not rely on Hank™ for medical decisions, emergency advice, diagnosis, treatment, or injury management.

Do not submit medical emergencies or urgent safety issues to Hank™. In an emergency, contact emergency services or a qualified healthcare provider.

5. User Accounts and Account Deletion

You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Notify us if you believe your account has been accessed without authorization.

If RiseMove™ supports account creation, RiseMove™ also provides an account deletion path in the app. You may also request account deletion through the instructions at risemoveapp.com/delete-account.

6. User Content, Sharing, and Community Standards

RiseMove™ may allow users to share activity-related content, profile information, activity summaries, notes, photos, comments, reactions, or other content with other users. You are responsible for the content you create or share.

By sharing content through RiseMove™, you grant RiseMove™ a limited, non-exclusive, worldwide, royalty-free license to host, display, transmit, reproduce, and process that content solely to operate and improve the app and related services.

You agree not to post, share, or transmit content that is false, misleading, harassing, abusive, threatening, hateful, defamatory, obscene, sexually explicit, exploitative, discriminatory, invasive of privacy, infringing, illegal, unsafe, or otherwise objectionable.

RiseMove™ may provide tools to filter objectionable material, report content, block users, remove content, restrict accounts, or respond to safety concerns. We may remove content or suspend accounts that violate these Terms or create risk to users, the app, or the community.

7. Third-Party Services

RiseMove™ may integrate with Apple Health, HealthKit, Motion and Fitness, Strava, Garmin, Google Health Connect, mapping providers, hosting providers, analytics providers, AI providers, or similar services. Your use of third-party services may be subject to those services’ own terms and privacy policies. Connecting third-party services is optional unless clearly required for a specific feature.

RiseMove™ is not endorsed by Apple, Strava, Garmin, or any other third party unless expressly stated.

8. Payments, Subscriptions, and In-App Purchases

The current public-facing website does not advertise active paid subscriptions or premium pricing. If RiseMove™ offers paid digital features, subscriptions, or in-app purchases in the future, those purchases will be presented clearly and handled through the applicable app store or approved purchase method where required.

Future paid offerings, if any, may be subject to additional terms, pricing, renewal, cancellation, refund, and restore-purchase information shown in the app or app store purchase flow.

9. Privacy

Your use of RiseMove™ is also governed by our Privacy Policy, which explains what data we collect, how we use it, HealthKit and location handling, AI processing, user content, retention, deletion, and your choices.

10. Prohibited Uses

Use the app unlawfully or in violation of these Terms.
Use the app to harass, threaten, abuse, or harm others.
Post objectionable, unsafe, infringing, or illegal content.
Attempt to reverse engineer, decompile, or extract source code.
Scrape, crawl, overload, interfere with, or disrupt the app or servers.
Impersonate another person or create misleading accounts.
Use RiseMove™ for emergency, medical, diagnostic, or treatment decisions.

11. Intellectual Property

RiseMove™, Hank™, the RiseMove™ name, logos, designs, software, features, content, and related intellectual property are owned by Paul Russell, RiseMove™ AI Coach, or applicable licensors and are protected by applicable intellectual property laws.

12. No Warranty

RiseMove™ is provided “as is” and “as available.” We do not guarantee that the app will be uninterrupted, error-free, accurate, secure, or suitable for your specific needs. Movement recommendations may not be appropriate for every person or situation.

13. Limitation of Liability

To the maximum extent permitted by law, RiseMove™, its developer, affiliates, service providers, and licensors shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including personal injury, property damage, lost data, lost profits, or damages arising from your use of or inability to use the app.

14. Indemnification

You agree to indemnify and hold harmless RiseMove™, its developer, affiliates, service providers, and licensors from claims, damages, losses, liabilities, and expenses arising from your use of the app, your content, your violation of these Terms, or your violation of another person’s rights.

15. Termination

We may suspend or terminate access to RiseMove™ if you violate these Terms, create risk, misuse the service, or if the app is discontinued. You may stop using the app or delete your account at any time.

16. Changes to Terms

We may update these Terms from time to time. Material changes may be communicated through the app, by email, or by posting the updated Terms on this website. Your continued use of RiseMove™ after changes are posted means you accept the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Orange County, Florida, unless applicable law requires otherwise.
